Koloku is operated by Ki Fung Lau, doing business as Logiciel Koloku (NEQ 2282691460).
Welcome to Koloku. In these Terms, "Koloku", "we" and "us" refer to Ki Fung Lau, doing business as Logiciel Koloku. By accessing our portal, registering students, subscribing to a paid plan, or opting into our notification system, you agree to comply with and be bound by the following Terms & Conditions. If you do not agree, please do not use the Service.
You must be at least 18 years old and authorized to act on behalf of the learning center you register to create a Koloku account. You are responsible for keeping your login credentials and admin PIN confidential, and for all activity that occurs under your account. Notify us promptly at support@koloku.app if you suspect unauthorized access.
Paid plans are billed on a recurring basis as described at signup and processed securely through Stripe. Free trials convert to a paid subscription unless canceled before the trial ends, where offered. You can cancel or change your plan at any time from the Billing Portal in your Admin Portal; cancellation takes effect at the end of the current billing period unless stated otherwise, and fees already paid are non-refundable except where required by law. We may change our prices. We will email you at least 30 days before a price change applies to your subscription. Centers that received Founding Member pricing (trial started on or before October 31, 2026) keep that pricing for as long as their subscription stays active, including when they change plans.
Koloku may, at its sole discretion, offer referral credits, free-month promotions, sign-up rewards, promo codes, or similar programs. Unless stated otherwise at the time an offer is made:
By opting into notifications during student profile setup or enrollment, parents and guardians expressly consent to receive automated attendance and check-out alerts via SMS text message from Ki Fung Lau (Koloku Center).
Consent to receive text messages is completely optional and is not required as a condition of enrollment, purchase, or completion of any service.
To provide support or fix a problem, Koloku may view your account in read-only mode, without making changes. These accesses are time-limited and logged.
If you enter information about your staff, you confirm that you are authorized to do so and that you have informed your staff that their information is stored in Koloku to manage schedules. Enter only what you need for scheduling. For staff who are minors, you are responsible for complying with any rules that apply to employing them, including limits on working hours; Koloku's warnings about availability or time off are a convenience, not a compliance check. Staff time-clock records are provided to help you; you remain responsible for the accuracy of your payroll records and for keeping them for as long as the law requires (you can download them from Koloku at any time).
Information about your students and their parents that you enter in Koloku, or that parents send through Koloku Parent (such as absence notes and schedule change requests), is your center's information. You are responsible for having the right to collect it and for telling families how it is used; Koloku processes it on your behalf, only to provide the Service, as described in our Privacy Policy.
For this information, Koloku acts as your service provider: we use it only to provide the Service and as you direct in Koloku; we protect it with the security measures described in our Privacy Policy; we entrust it only to the providers named there, under written agreements; we notify you promptly of any incident affecting it; and we delete it on the schedule in our Privacy Policy after your subscription ends. You can download a full copy at any time (Admin › Database).
We do not share, sell, or provide user opt-in information or mobile data to third parties for marketing or promotional purposes. For more information, please review our Privacy Policy.
You agree to use Koloku only for its intended purpose of managing a learning center's student attendance, staff schedules and related communications, and not to misuse the Service -- including attempting to access another organization's data, disrupting the Service, or using it to send unlawful, abusive, or unsolicited messages.
The Koloku name, logo, and the software, design, and content that make up the Service are owned by Koloku, and all rights not expressly granted to you are reserved. Data you enter about your center, staff, and students remains yours; you grant Koloku a limited license to host, process, and transmit it solely to provide the Service to you.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or available at all times.
To the fullest extent permitted by law, Koloku and Ki Fung Lau shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, revenue, or business, arising out of or related to your use of the Service. Koloku's total liability for any claim relating to the Service is limited to the amount you paid Koloku in the 3 months preceding the claim.
We may suspend or terminate access to the Service for any account that violates these Terms, has a lapsed or failed payment, or poses a security risk to Koloku or other customers. You may stop using the Service and cancel your subscription at any time as described above.
We may update these Terms from time to time. Material changes will be reflected by an updated "Last Updated" date above; continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
Koloku is an independent product and is not affiliated with, endorsed by or sponsored by Kumon.
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
